The protection and the security of your personal data are of prime importance to the Institute for Compliance and Quality Management AG („ICQM“) and service providers. ICQM acts in strict compliance with the applicable data protection policies and data protection legislation so that you can feel safe when visiting our website.

It is important to us that you always know what personal data is being recorded when you visit our website (via direct access or because you were forwarded to it by other digital information channels) and use our services and offers and the purposes for which use this data. The following sections contain the relevant information on this and describe the measures we take to protect your personal data from tampering, loss, destruction or unlawful use. We have also taken technical and organizational measures which ensure that the data protection regulations are observed by us as well as by our service providers.

  1. Collection and use of personal data

Personal data means data, which can enable conclusions to be made about your identity, i.e. name, address, telephone number or E-mail address (“personal data”). We will only collect, process or use your personal data to the extent permissible by law and authorized by you. Your personal data can be collected, processed or used for the following purposes in particular.

The data which you send us in connection with your visit to our website primarily depends on the browser used and its settings. If your settings allow, we will use cookies and similar tools to enable you an optimal surfing experience on our website. This includes information such as the region in which you are located, the language you have selected and the products and services which you prefer. This way, we can recognize you on your next visit. You can also visit our websites completely anonymously.

We may need additional personal data from you to provide services and process requests. This data is combined with the above-mentioned data from your visit to the website in order to offer you content and services which are tailored to your needs as accurately as possible. Various contact forms are available on our website which can be used to register for seminars or tours and for communication. If a user makes use of this option, the personal data entered in the entry mask will be sent to us and saved by us. The personal data from the contact form is transferred in encrypted form. Additional data such as IP address and time of sending will be transferred when the data is sent.

Your consent to the processing of the personal data will be obtained and this data privacy statement will be referred to before the data is sent. You may also contact us by way of the specified E-mail addresses as an alternative. The data is used exclusively for the purposes stated or associated with the form in question.

  1. Our justifications for processing your data

(i) Fulfilment of a contract

This is especially the case if you register for a seminar or a tour. The minimum statements necessary to fulfil the contract are marked with an asterisk without the minimum contractual or statutory statements, we will not be able to process your order. Other statements may be helpful for us and you, but are voluntary. Without your further consent, we will only use the personal data you provide to process your order.

In the case of a contact request, we will only use your personal data to process your request and contact you.

(ii) Statutory provision

Commercial and/or fiscal law obligates us to save certain information such as your address, payment and order data for a period of up to eleven years (depending on the countries relevant for this process).

(iii) Your consent

We ask prospective customers for their express consent and agreement with this data privacy statement for advertising purposes, i.e. providing information about seminars, tours, news, company information, invitations to trade fairs or events in electronic form or by telephone (hereinafter “product information”) as well as electronic or telephone customer analyses, surveys on customer satisfaction, contests and promotional letters. This can be done by such means as creating application forms via our website. After receiving your consent, we will save your E-mail address for the purpose specified upon creation, including product and service information.

Your rights to disclosure and revocation of your consent can be found in the following Section 12.

(iv) Further legitimate interests of ICQM

ICQM has a justified interest in operating a website upon which prospective customers receive information about ICQM products and offers. ICQM has a legitimate interest in finding out which information and offers are most interesting. Furthermore, ICQM has a legitimate interest in protecting its website and organization from abuse and other unauthorized use of this website. For further details, see the following Section 8.

  1. Information exchange with service providers

In the context of the fulfilment of contracts, for the processing of enquiries or other purposes mentioned in Section 3, ICQM may involve third parties (e.g. specialists for technical support, communication partners or service providers for the execution of requests, e.g. for the handling of payments) who thereby may view data, but only to the extent that this is necessary for the fulfilment of the service. ICQM ensures that third parties process personal data only in accordance with the requirements of the applicable data protection laws.

This may lead to the data collected being sent to countries which, in the view of the EU and/or Switzerland, do not have an adequate level of data protection legislation. However, in cases in which this takes place, ICQM has implemented suitable guarantees to ensure sufficient protection of the personal data. You may request further information on this at the contact address specified in Section 11.

  1. Storage limitation

Unless indicated otherwise, the personal data will be stored until the purpose is achieved. ICQM may be required to retain data for financial accounting, fiscal or other legal reasons. This period of time depends on the data and countries in question and generally does not amount to more than eleven years. Data used in the scope of web analysis is generally deleted within a few days, or is completely anonymized.

It is your duty to store your data which you consider to be necessary. We are not obligated to store this data and can delete the data at any time, especially if we are of the opinion that we have more no obligations than that to store retain the data.

  1. Automated decision-making

We do not use any automated decision-making (“profiling”) to establish and maintain business relationships.

We or the service providers (on our behalf) may use web analysis tools, especially tracking technology in order to advice you and provide you with product information in a targeted manner. They enable communication and advertising based on your needs. With this in mind, we refer to the following Section 8.

  1. Cookies and web tracking

(i) Cookies
We use cookies in certain areas in order to make our internet site user-friendly and tailor it optimally to your needs. Cookies are small text files which are saved locally on your hard drive. The information saved will be accessed later to simplify the use of our online offers.

(ii) Web tracking
When you visit our website, cookies will also be used to analyze your usage behavior on our website (web tracking). The data which the cookies create about your usage behavior (search engines and keywords used, your language, country of origin, browser and plug-ins used, the referring site, your dwell time, entrance and exit pages, cancel rates and your IP address) is anonymous and serves purely statistical purposes (data traffic analyses). (i) Facebook
Our website uses social plug-ins (hereinafter “plug-ins”) from the social network Facebook, which is operated by Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (hereinafter “Facebook”). If you access a page of our website which contains such a plug-in, your browser will establish a direct connection to Facebook’s servers. The contents of the plug-ins are transferred from Facebook directly to your browser and integrated into the site. This incorporation gives Facebook the information that your browser has accessed the relevant page of our website, even if you do not have a Facebook profile or are not logged into Facebook at the moment. Your browser will transfer this information (including your IP address) directly to a Facebook server in the USA, where it will be saved. (ii) LinkedIn

Our website uses functions of the network LinkedIn. It is provided by LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA. Every time our pages containing LinkedIn functions are accessed, a connection to LinkedIn’s servers is established. LinkedIn is informed that you have visited our webpages with your IP address. If you click on LinkedIn’s “Recommend” button and are logged into your LinkedIn account, then LinkedIn will be able to allocate your visit to our internet site and your user account. We hereby inform you that, as provider of the pages, we have no knowledge of the contents of the data transferred and the use thereof by LinkedIn.

(iii) Twitter

On our website so-called social plugins ("plugins") of the microblogging service Twitter by Twitter Inc, 1355 Market St, Suite 900, San Francisco, CA 94103, USA ("Twitter") are used. The plugins are provided with a Twitter logo, for example in the form of a blue "Twitter bird". If you access a page of our website that contains such a plugin, your browser does not support a direct connection to the servers of Twitter. The content of the plugin is provided by Twitter directly to your browser and integrated into the page. This information (including your IP address) is sent directly from your browser to a server from Twitter to the USA and stored there.
